Title VI

Palm Tran, as a proud and active member of the Palm Beach County community, is committed to a non-discrimination policy that ensures all residents and riders are treated with dignity, respect, and equality.

What is Title VI?

Title VI of the Civil Rights Act of 1964 prohibits discrimination based on race, color, or national origin in programs and activities receiving federal financial assistance. Specifically, Title VI states:

“No person in the United States shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.”

(42 U.S.C. Section 2000d)

Palm Tran is committed to upholding these protections, including the Environmental Justice component of Title VI, which guarantees fair and equitable treatment for all individuals. Palm Tran takes steps to identify and address any disproportionately high and adverse effects of its programs, policies, and activities on minority and low-income populations. These efforts include ensuring that Limited English Proficiency (LEP) individuals have meaningful access to Palm Tran’s programs, services, and information.

Environmental Justice regulations exist to:

  • Avoid, minimize, or mitigate disproportionately high and adverse human health and environmental effects, including social and economic effects, on minority and low-income populations
  • Ensure the full and fair participation by all potentially affected communities in the transportation decision-making process
  • Prevent the denial of, reduction in, or significant delay in the receipt of benefits by minority and low-income populations

 

Filing a Title VI Complaint

Any person who believes they have been discriminated against on the basis of race, color, or national origin by Palm Tran may file a Title VI complaint. Complaints must be filed within 180 days of the alleged incident. Palm Tran takes all complaints seriously and ensures a fair and thorough investigation.

Investigation Process

All complaints will be investigated promptly and confidentially. Palm Tran’s Customer Service Section and the Office of Equal Opportunity will conduct a thorough review and notify the appropriate parties. The investigation may include, but is not limited to:

  • Reviewing relevant written, audio, or video materials, procedures, and practices
  • Interviewing individuals with knowledge of the alleged incident, including the complainant, witnesses, or others identified during the investigation
  • Identifying if others have experienced similar conduct

Reporting and Resolution

After the investigation is complete, the Customer Service Administrator or their designee will prepare a final report with oversight from the Manager of Equal Opportunity. If a violation of Title VI is found, appropriate remedial actions will be taken.

Regardless of the outcome, a closure letter summarizing the complaint and findings will be sent to the complainant by the Manager of Equal Opportunity.
